1. Who we are
Motoloop is operated by Gustavo Vargas (a sole freelancer), as named in our Imprint. By using the app or the business console you agree to these terms.
2. Rider accounts
Riding features are free. You're responsible for the accuracy of content you post and for riding safely and lawfully. Routes and navigation are provided "as is" — always follow road rules and your own judgement.
3. Business accounts & billing
Businesses claim a profile for free and may subscribe to a paid plan (Verified or Featured). Subscriptions and any per-lead or extra-post charges are billed via Stripe per the pricing in effect. Subscriptions renew monthly or annually and can be cancelled any time, effective at the end of the current billing period; the current period is not refunded. Statutory withdrawal rights for consumers remain unaffected.
4. Leads & offers
Motoloop connects riders and businesses. Any booking, offer, service or payment is a direct agreement between the rider and the business. Motoloop is not a party to it and is not responsible for fulfilment, quality, cancellation fees or disputes between the parties.
5. Acceptable use
No unlawful, harmful, infringing or fraudulent content; no scraping, abuse of the rider-intent signals, or attempts to deanonymise riders. We may suspend accounts that breach these terms.
6. Content & IP
You keep ownership of the content you create and grant Motoloop a non-exclusive licence to host and display it within the service. You're responsible for holding the rights to anything you upload.
7. Liability
Motoloop is provided with care but "as is". To the extent permitted by law, we are liable without limitation only for intent and gross negligence and for injury to life, body or health. For slight negligence we are liable only for breach of essential contractual obligations (cardinal duties), limited to foreseeable, typical damage. Mandatory statutory liability (e.g. under the Product Liability Act) remains unaffected.
8. Changes
We may update these terms; material changes will be notified in-app or by email.
9. Governing law
These terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of your country of residence remain unaffected.
